U.S. District Judge C. Weston Houck has rejected the Episcopal Church's requests to litigate South Carolina secession case in federal court. In a 20 page ruling handed down on 10 June 2013 Judge Houck rejected that as a matter of law  TEC's claim that federal trademark law preempts South Carolina law was incorrect. TEC second claim, that the first amendment to the U.S. Constitution requires the case to be litigated in federal court, was also false as in the proceedings before the court, "the First Amendment issue is not necessarily raised", "not actually disputed", "not substantial", and that "removal of this case would disrupt the federal state balance approved by Congress."

... One of [Justin Welby's] responsibilities is towards the Anglican Communion which is currently suffering from impaired and broken relationships. Archbishop Justin will definitely need to accurately diagnose the reasons for these divisions in order to come up with the correct treatment. One of the first challenges he will face is to understand how the nature of the Anglican Communion has changed in the last decades. Statistics show that there are now more Anglicans in the “South” than in the “North.”

First was the ordination of a non-celibate lesbian in the former home of the Falls Church  Anglican parish this past December. This was a problem of both menu and venue, of what  and where it was done. This kind of ordination, which violates scriptural teaching, caused  the Anglican schism in the first place. I believe that holding the service at the Falls Church  shortly after they lost their building showed a disregard and lack of respect for the good and  godly pastor and the people of the Falls Church. This was a failure to treat others in a way  that honors the imago dei in each of us. It was extremely painful to learn of this action and  my full sympathy is with John Yates+ and his congregation.
